Event terms and conditions:

These Event Terms (Terms) govern your purchase of tickets for, and attendance to the virtual event, O2N | 2022 Resources, Energy and Industry Innovation Forum. It is your responsibility to review these Terms prior to the purchase of tickets and upon entry to the virtual event. By purchasing tickets you agree to be bound by these Terms. We reserve the right to amend these Terms at any time, and will provide the most recent version on our website.

Throughout these Terms, the terms “Orana Opportunity Network”, “O2N”, “we”, “us” and “our” refer to Orana Opportunity Network Pty Ltd and its associated entities, and “you” refers to the individual or business purchasing tickets or attending the Event.

  1. Event Booking and Ticket Purchase

1.1. Event details and ticket prices are available on our website.
1.2. O2N Members may access discounted ticket. Discount code will be sent directly to the member’s provided email. Proof of membership may be required.
1.3. In addition to the ticket, you must pay GST and any booking, handling, credit card surcharge or postage fees specified on our website.
1.4. Ticket prices are subject to change, and O2N will use best endeavours to inform you if there is a change.
1.5. You may make a booking and/or purchase a ticket for an Event:
1.5.1. online via our website; or
1.5.2. by submitting a request for a manual invoice to o2n@o2n.org.au with the name of the Event, location, number of tickets and requested invoicing details.
1.6. If you choose to book via our manual invoicing process:
1.6.1. your request is subject to approval by O2N;
1.6.2. full payment must be received at least 24 hours prior to the Event. If full payment is not received by this time, the booking will be cancelled with no notice to you;
1.7. Your booking is confirmed when you receive an email notification and receipt from O2N/the booking platform Eventbrite. We will maintain a list of confirmed and paid up attendees for each Event, and you may gain entrance to the Event via the link shared with you prior to the Forum. You will not receive a hard copy or electronic ticket.

  1. Refunds, Credits and Transfers

2.1. All ticket sales bookings are final. No exchange, credit or refund will be given except in the case of certain cancelled or rescheduled the Event (see clause 3 below). For clarification, you are not entitled to a refund if:
2.1.1. you did not enjoy the Event;
2.1.2. you are no longer able to attend the Event; or
2.1.3. you arrive late or are refused entry for any reason.
2.2. a ticket booking is transferrable to another person on the following conditions:
2.2.1. a request is submitted in writing to o2n@o2n.org.au containing the replacement guest name, business name and email address.
2.2.2. the request is submitted at least 48 hours prior to the Event.
O2N reserves the right to refuse entry if a replacement guest arrives at the Event without the ticket being transferred via this procedure.

  1. Event Cancellation or Postponement

3.1. The Event can be cancelled, varied, rescheduled or postponed due to Force Majeure Events, situations which affect the guest speakers, increased restrictions/government imposed lockdown requirements due to pandemics or other causes.
3.2 If an Event is postponed:
3.2.1 you may, at your option exercisable by notifying us in writing no later than 30 days after the originally scheduled date of the postponed Event, obtain a credit for the ticket price to put towards another of our Event that occurs within 12 months of the originally scheduled date of the postponed Event; or
3.2.2 if you so elect, or if you fail to notify us in writing of your request for a credit within 30 days after the originally scheduled date of the postponed Event, your ticket will be automatically transferred to the new date for the postponed Event.
3.3. If an Event is cancelled and/or a new date for the Event is not announced within 60 days of the postponement/cancellation:
3.3.1  in circumstances where the Event is cancelled due to a Force Majeure Events or increased restrictions/government imposed lockdown requirements due to pandemics, you will be given a credit for the ticket price to put towards another of our Events that occurs within 12 months of the originally scheduled date of the cancelled Event (no refunds will be issued);
3.3.2 in circumstances where the Event is cancelled for any reason other than a Force Majeure Events or increased restrictions/government imposed lockdown requirements due to pandemics, you may, at your option exercisable by notifying us in writing no later than 30 days after the originally scheduled date of the cancelled Event, obtain a refund of the ticket price (excluding booking, credit card and other fees).  If you so elect, or if you fail to notify us in writing of your request for a refund within 30 days after the originally scheduled date of the cancelled Event, you will be given a credit for the ticket price to put towards another of our Events that occurs within 12 months of the originally scheduled date of the cancelled Event.
3.3. We will use reasonable endeavours to notify ticket holders of a cancellation, variation, rescheduling or postponement of an Event by sending an email to the address provided to us by the ticket holder and putting a notice on our website; however the responsibility to ascertain whether an Event has been cancelled, varied, rescheduled or postponed is yours. We do not guarantee that ticket holders will be informed of a cancellation, variation, rescheduled or postponement before the date of the Event.
3.4 Except as expressly provided in this clause 3, in no circumstances will ticket prices (or any part thereof) be refunded or credited. Any refund or credit issued will be your sole remedy for a postponement or cancellation of an Event, and we will have no further liability to you in respect of any cancellation, variation, rescheduling or postponement of an Event for any reason. Any credits issued for the postponed or cancelled Event that are not used within 12 months of the originally scheduled date of the postponed/cancelled Event will be forfeited.
3.5 O2N is not responsible for any unstable connections or technical malfunctions that may result in you not accessing the online Event or the interuption/drop-out of the online Event. In this event O2N will not provide a refund.  

  1. Event Conduct

4.1. You are expected to behave in a professional and appropriate manner during the virtual Event. We reserve the right to refuse entry or require you to leave the online Event if your behaviour is deemed unacceptable.
4.2 You are required to not share their access link to the online Event with anyone. If logins from non-ticket holders can be seen in the backend of the virtual platform, O2N reserves the right to remove them from the online Event.
4.3. You acknowledge that a recording (video and audio) of the virtual Event will be used across O2N’s channels in perpetuity.
4.4. You consent to being filmed by O2N (or its representatives) and to O2N using your name, likeness, image and/or voice in such recordings for the purpose of promoting our events, services and products. No remuneration is payable for such use.

  1. Limitation of Liability

5.1. To the extent permitted by law, we exclude all conditions and warranties relating to your purchase of tickets for and attendance at the Event.
5.2. Where our liability cannot be excluded, such as in relation to Consumer Guarantees under the Australian Consumer Law or other prescribed terms under the legislation, our liability for breach is limited to the face value of the ticket purchased by you, plus any relevant booking and delivery fees.
5.3  We will be excused from performance under these Terms and in relation to the Event to the extent such performance is affected by a Force Majeure Events or increased restrictions/government-imposed lockdown requirements due to pandemics.

  1. Miscellaneous

6.1. These Terms shall in respect be governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts in New South Wales to determine any matter or dispute which arises under these Terms.
6.2. If any provision of these Terms is deemed invalid or unenforceable, all or part of that provision will be severed from the Terms and will not affect the enforceability of the remaining provisions of the Terms.
6.3. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term. Any failure to assert any right under the Terms shall not constitute a waiver of such right.
6.4 In these Terms, a “Force Majeure Events” means any of the following (whether or not foreseeable or anticipated): acts of God, terrorism, war, civil unrest, strike or labour dispute, lack of transportation, breakdown, labour or material shortage, blockade or embargo, supplier failure, epidemic or pandemic, government restriction or recommendation, legal requirement, extreme weather, earthquake, drought, fire, flood, explosion, natural disaster, and/or any other event, cause or circumstance that is beyond our reasonable control.
6.5. These Terms constitute the entire agreement between O2N and you in relation to the Event.
